HEAREN — TERMS OF USE
Last updated: 6 October 2026
These Terms of Use ("Terms") govern access to and use of the Hearen application and related services ("Hearen" or the "Service"). Hearen is provided by:
HEAREN LAB LIMITED
Private company limited by shares incorporated in England and Wales
Company Number: 17006631
Registered office: 72 Halliwick Road, London, England N10 1AB, United Kingdom
Email: contact@hearen.io
Telephone: +44 20 3996 9083
By creating a Hearen account, you confirm that you have read and agree to these Terms.
1. About Hearen
Hearen is a wellbeing application providing sound-based, relaxation and support tools intended in particular for people living with tinnitus.
Hearen is not presented as a medical device and does not provide medical diagnosis, medical treatment or medical advice.
Features including Soundscapes, Cocoon, SOS Calm, breathing experiences and Hera are wellbeing and support tools.
Features relating to hearing, including the Hearen listening test, hearing profiles, audiogram data and sound personalisation, are intended to personalise the user's experience. They are not a substitute for an audiological examination, medical diagnosis or care provided by a qualified healthcare professional.
2. Age requirement
Hearen is intended for users aged 18 or over.
By creating an account or using the Service, you represent that you are at least 18 years old.
3. User accounts
Certain features of Hearen require a personal account.
You are responsible for providing information reasonably required for the operation of your account and for keeping your login credentials secure.
You must not knowingly allow your account to be used fraudulently or in a manner contrary to these Terms.
If you believe that your account has been accessed without authorisation, you may contact HEAREN LAB LIMITED at contact@hearen.io.
Information entered or imported into Hearen for the purpose of personalising the Service is not treated by HEAREN LAB LIMITED as a medical declaration and is not medically verified by Hearen.
The processing of personal data is governed by Hearen's Privacy Policy.
4. Free trial
Hearen may provide new eligible users with seven (7) days of full access to the Service free of charge.
No paid subscription is required to begin this trial.
The Hearen free trial does not automatically convert into a paid subscription at the end of the seven-day period.
Unless the user voluntarily purchases a subscription, no paid Hearen subscription is automatically initiated when the trial ends.
At the end of the free trial, continued access to subscription features requires an active subscription or another form of access granted by HEAREN LAB LIMITED.
5. Subscriptions and payments
Hearen may offer monthly and annual subscriptions providing access to the features and content included in the subscription offer presented within the application.
Prices are those displayed through the App Store at the time of purchase and may vary according to country, currency, taxes and the applicable App Store conditions.
Purchases made through the Apple App Store are processed by Apple in accordance with the applicable App Store terms.
Where a subscription is configured to renew automatically, renewal and billing are handled in accordance with the conditions presented by Apple when the subscription is purchased.
Users can manage or cancel their subscription through their Apple account and the subscription management facilities provided by Apple.
Unless otherwise required by applicable law or the relevant App Store terms, cancellation of a subscription takes effect at the end of the period already paid for. Access included with the subscription therefore normally continues until the end of that period.
Requests for refunds of transactions processed by Apple are handled in accordance with Apple's applicable refund procedures and legal obligations.
The Restore Purchases function allows eligible App Store purchase rights associated with the user's Apple account to be restored within Hearen. Using this function does not itself create a new purchase.
6. Access to Hearen
Access to certain Hearen features and content may require an active free trial, an active subscription or another form of access granted by HEAREN LAB LIMITED.
The features and content included in each form of access are those presented within Hearen at the relevant time.
HEAREN LAB LIMITED may develop, improve, add, modify or remove features and content as the Service evolves.
Any material change adversely affecting a paid service will be handled in accordance with applicable consumer law.
A subscription provides a right to access and use the relevant Hearen service. It does not constitute the purchase or transfer of ownership of individual content made available through Hearen.
7. Personal use of Hearen content
Content made available through Hearen, including soundscapes, sounds, compositions, sound environments, voice recordings, Hera messages, audio exercises, text, illustrations, graphics and other content, is provided solely for personal and non-commercial use within the Hearen Service.
Access to Hearen, during a free trial or through a paid subscription, does not transfer ownership of that content or grant any right to exploit it outside Hearen.
Except with the prior written permission of HEAREN LAB LIMITED or where expressly permitted by applicable law, Hearen content must not be copied, extracted, captured, recorded, reproduced, republished, redistributed, broadcast, transmitted, sold, licensed, made available to third parties, incorporated into another product or service, or otherwise exploited outside the personal use of Hearen.
Users must not circumvent or attempt to circumvent technical measures designed to protect content or control access to it.
8. Listening profiles, audiograms and sound personalisation
Hearen listening test
The listening test available within Hearen is intended to contribute to the personalisation of the user's sound experience.
A Hearen listening profile is not a clinical audiogram. The Hearen listening test is not an audiological examination, medical diagnosis or medical assessment of hearing.
Audiogram information
Where supported, Hearen may use audiometric information made available by the user, including audiogram information obtained through compatible Apple Health functionality, to personalise certain sound experiences.
Such use does not constitute medical interpretation or validation of the audiogram.
Apple Health and HealthKit
Access to compatible Apple Health information is optional and subject to the permissions granted by the user through Apple's HealthKit framework.
Users can manage or withdraw HealthKit permissions using the controls provided by Apple.
Refusing or withdrawing access to Apple Health does not prevent use of Hearen as a whole, although certain personalisation features may be unavailable or may use another available source of information.
The results of sound personalisation may depend on the availability, quality and relevance of the information used, as well as the listening equipment, device settings and listening environment.
HEAREN LAB LIMITED does not guarantee that a particular listening profile will produce identical results or perceptions on every device, headset, pair of headphones or listening environment.
9. Hera and SOS Calm
Hera is the accompanying voice integrated into certain Hearen experiences.
Hera may deliver voice messages intended to accompany the user during wellbeing, relaxation or listening sessions.
In these experiences, Hera provides pre-defined accompanying voice messages and does not respond individually to the user.
Messages delivered by Hera are provided for wellbeing and support purposes and do not constitute medical advice, diagnosis or treatment.
SOS Calm and the Hera messages accompanying it are relaxation and wellbeing tools. They are not intended to replace medical or professional assistance when such assistance is required and are not an emergency service.
10. Wellbeing, listening safety and medical limitations
Hearen should be used reasonably and at a listening level appropriate to the user's circumstances, particularly when headphones or earphones are used.
Users should reduce the volume or discontinue listening if they experience discomfort.
The effects and perception of the experiences provided through Hearen can vary between individuals. HEAREN LAB LIMITED does not guarantee any particular therapeutic, auditory or wellbeing outcome from use of the Service.
Hearen does not replace advice, assessment or care from a qualified healthcare professional.
Users experiencing new, sudden, unusual or concerning symptoms should seek appropriate professional advice rather than rely on Hearen for medical assessment.
Hearen is not an emergency service.
11. Intellectual property
Hearen and the intellectual property associated with the Service, including its software, interfaces, design, text, graphics, illustrations, sounds, compositions, sound environments, Hera voice content and other original material, are owned by HEAREN LAB LIMITED or used under rights or licences held from their respective owners.
Subject to these Terms, the user is granted a personal, limited, non-exclusive, non-transferable and revocable right to use Hearen for personal purposes.
No ownership or intellectual property right is transferred to the user.
The Hearen name, logos and distinctive signs may not be used in a manner that falsely suggests affiliation with, authorisation by or endorsement from HEAREN LAB LIMITED.
Except where expressly permitted by applicable law, users must not reverse engineer, decompile, disassemble or otherwise attempt to derive source code or protected technical elements of Hearen.
Nothing in these Terms is intended to prevent uses that cannot lawfully be restricted, including applicable statutory exceptions.
12. Prohibited use
Users must not:
- use Hearen or its content for unauthorised commercial exploitation or redistribution;
- unlawfully copy, extract or distribute Hearen content;
- circumvent subscription, access-control or content-protection mechanisms;
- attempt to gain unauthorised access to Hearen systems, accounts or data;
- interfere with the proper operation or security of the Service;
- use Hearen fraudulently or unlawfully; or
- use the Service in a manner that infringes the rights of HEAREN LAB LIMITED or third parties.
13. Availability, maintenance and changes to Hearen
HEAREN LAB LIMITED takes reasonable steps to maintain the operation and availability of Hearen.
The Service may nevertheless occasionally be interrupted due to maintenance, updates, technical corrections, security requirements or circumstances outside HEAREN LAB LIMITED's reasonable control.
HEAREN LAB LIMITED does not guarantee uninterrupted availability of Hearen at all times.
Hearen may evolve over time. Features and content may be corrected, improved, added, replaced or removed as part of the development of the Service.
Material changes affecting paid services remain subject to applicable consumer rights.
The availability and operation of certain features may depend on the user's device, operating system version, headphones or other equipment, internet connectivity, device settings or third-party services.
HEAREN LAB LIMITED does not guarantee indefinite compatibility with every device or every previous version of an operating system.
14. Third-party services
Hearen may depend on services, platforms, technologies or infrastructure provided by third parties, including Apple.
Use of those services may also be subject to the applicable terms of the relevant third party.
HEAREN LAB LIMITED is not responsible for failures caused exclusively by services or circumstances outside its reasonable control, except where responsibility cannot lawfully be excluded or limited.
Nothing in these Terms transfers to a third party any responsibility that applicable law places on HEAREN LAB LIMITED.
15. Suspension and termination
Users may stop using Hearen at any time and may request deletion of their Hearen account through the mechanisms made available by the Service or by contacting HEAREN LAB LIMITED.
Personal data associated with account deletion will be handled in accordance with the Hearen Privacy Policy and any applicable legal retention requirements.
HEAREN LAB LIMITED may suspend or terminate access to an account where reasonably necessary, including in cases of fraud, serious security risk, manifest abuse, or serious or repeated violation of these Terms.
Where reasonably possible, the user will be informed of such action. Immediate action may be taken where necessary to protect the Service, its users or third parties.
Deleting a Hearen account does not automatically cancel an Apple App Store subscription.
Users who have an active App Store subscription must separately manage or cancel that subscription using Apple's subscription management facilities.
16. Liability and consumer rights
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
Nothing in these Terms affects mandatory statutory rights available to consumers.
HEAREN LAB LIMITED is responsible for the Service in accordance with applicable law.
To the extent permitted by applicable law, HEAREN LAB LIMITED is not responsible for losses resulting solely from circumstances outside its reasonable control, incompatible or defective third-party equipment, unauthorised modification of the user's device or software, or third-party services for which HEAREN LAB LIMITED is not legally responsible.
No provision of these Terms is intended to exclude rights or remedies available to consumers in relation to digital content or services where such rights cannot lawfully be excluded.
17. Changes to these Terms
HEAREN LAB LIMITED may amend these Terms where reasonably necessary, including to reflect changes to Hearen, its functionality, business operation or applicable legal or regulatory requirements.
Where a change is material, users will be informed in an appropriate manner before the change takes effect where required by applicable law.
Where applicable law requires the user's express consent to a change, such consent will be requested.
The date shown at the beginning of these Terms indicates when they were last updated.
18. Governing law and consumer protection
These Terms are governed by the laws of England and Wales.
However, if you are a consumer resident in a country whose mandatory laws provide protections that cannot contractually be excluded, those protections remain unaffected by this choice of law.
Nothing in these Terms deprives a consumer of rights or remedies that cannot lawfully be waived under the laws applicable to that consumer.
19. Disputes
If you have a complaint or dispute concerning Hearen, you are encouraged to contact HEAREN LAB LIMITED first at contact@hearen.io so that the matter can be reviewed and, where possible, resolved directly.
Subject to any mandatory jurisdictional rights available to consumers in their country of residence, the courts of England and Wales shall have jurisdiction in relation to disputes arising from these Terms or the Service.
20. Apple App Store provisions
Where Hearen is downloaded or used through the Apple App Store, the following provisions also apply.
These Terms are concluded between the user and HEAREN LAB LIMITED, and not with Apple Inc. ("Apple"). HEAREN LAB LIMITED, not Apple, is responsible for Hearen and its content.
The licence granted to the user is a non-transferable licence to use Hearen on Apple-branded products owned or controlled by the user, subject to the usage rules applicable to the Apple App Store, except to the extent that use by other accounts is permitted by Apple's applicable rules, including where applicable through Family Sharing.
HEAREN LAB LIMITED is responsible for providing maintenance and support for Hearen as required under these Terms or applicable law. Apple has no obligation to provide maintenance or support services for Hearen.
To the extent required by Apple's applicable terms, if Hearen fails to conform to an applicable warranty, the user may notify Apple and Apple may refund the applicable purchase price for the application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Hearen. Other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to an applicable warranty remain the responsibility of HEAREN LAB LIMITED to the extent required by applicable law.
HEAREN LAB LIMITED, and not Apple, is responsible for addressing claims relating to Hearen or the user's possession or use of Hearen, including product liability claims, claims concerning compliance with applicable legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation, including claims relating to Hearen's use of HealthKit.
In the event of a third-party claim that Hearen or the user's possession and use of Hearen infringes that third party's intellectual property rights, HEAREN LAB LIMITED, and not Apple, is responsible for the investigation, defence, settlement and discharge of such claim to the extent required by applicable law.
The user represents that they are not located in a country or region subject to a United States Government embargo or designated by the United States Government as supporting terrorism, and that they are not listed on any United States Government list of prohibited or restricted parties.
The user must comply with applicable third-party terms when using Hearen.
Apple and its subsidiaries are third-party beneficiaries of these Terms in relation to Hearen. Upon the user's acceptance of these Terms, Apple has the right to enforce the applicable provisions of these Terms against the user as a third-party beneficiary.
For questions, complaints or claims relating to Hearen, users should contact HEAREN LAB LIMITED, 72 Halliwick Road, London, England N10 1AB, United Kingdom; Email: contact@hearen.io; Telephone: +44 20 3996 9083.
21. Entire agreement and severability
These Terms, together with any documents expressly incorporated into them, govern the contractual relationship between the user and HEAREN LAB LIMITED concerning use of Hearen.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law without affecting the validity of the remaining provisions.
A failure by HEAREN LAB LIMITED to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or of the right to enforce it subsequently.
